House of Delegates Introduces Subcontractor Equal Access to Bonding Act of 2013


On January 31, 2013, Maryland Delegate Kirill Reznik of Montgomery County along with 19 other Delegates introduced House Bill 585 (“HB585”), which, if passed and signed by the Governor, would add Section 13-227 to the State Finance and Procurement Article and be known as the “Subcontractor Equal Access to Bonding Act”.  The bill, among other things, seeks to prohibit a prime contractor on a State project from requiring a subcontractor to provide bonding that is more stringent than the bonding requirements that the State imposes on the prime contractor.   Specifically, HB585 references Sections 13-207, 13-216 and 17-104 of the State Finance and Procurement Article, which outline the current bonding requirements that the State may impose on the prime contractor.
